Since 2015, LCB-FT requirements applicable to the banking and non-banking sectors have been steadily tightening at both European and national levels. On April 9, the ACPR issued its first sanction of 2024 against TREEZOR, fining it 1 million euros for breaches observed in 2021, deemed very serious and seriously affecting its LCB-FT system. The decision is particularly instructive in terms of the French regulator's expectations.
Noting the real need to pursue, at European level, the actions of control, supervision and repression, within a harmonized framework, the European Parliament has issued a new directive on the mechanisms to be put in place by Member States to prevent the use of the financial system for the purposes of BC/FT, a Regulation on the prevention of the use of the financial system for the purpose of money laundering and terrorist financing (AML/CFT), mainly setting out expectations in terms of the mechanisms to be implemented by those subject to the law, and a Regulation establishing the Autorité de Lutte Contre le Blanchiment de Capitaux et le Financement du Terrorisme (ALBC), as a supervisory authority integrated into the European system of financial supervision. These 3 texts were drawn up on May 31 and published on June 19.
